Why Choose Lai & Turner Law Firm PLLC for Child Custody in Tulsa, OK?
Family Law Attorneys With Oklahoma Custody Experience
Attorney Eric Strocen handles family law at our firm, including child custody cases. Eric earned his Bachelor of Science in Criminal Justice from Bacone College and his Juris Doctor from the University of Oklahoma College of Law. He is a member of the Oklahoma Bar Association and has six years of experience handling custody disputes, modifications, and visitation issues in Oklahoma district courts.
Our firm handles the full range of family law matters, including custody, divorce, paternity, child support, and guardianship. That breadth matters because custody issues rarely exist in isolation.
A Results-Oriented Approach to Custody
Custody cases come down to facts, preparation, and credibility. The parent who presents the most organized, well-documented case to the judge has the advantage. We prepare our clients for what the court will evaluate, what evidence matters most, and how to present their case in the strongest possible light. When agreement is possible, we work toward it. When it is not, we are prepared for contested hearings.
Free Consultations
We provide free consultations for all family law matters, including child custody. That initial conversation helps you understand what Oklahoma law says about your situation, what the court is likely to consider, and what your realistic options are before you make any commitments.

Types of Child Custody Cases We Handle in Tulsa
Custody cases in Oklahoma involve a range of circumstances, from initial custody determinations to post-decree modifications and enforcement actions. The legal process differs depending on whether the parents are married, unmarried, or dealing with a change in circumstances after an existing order was entered. We handle all types of custody matters in Tulsa, OK.
- Initial custody determinations. When parents separate or divorce, the court establishes a custody arrangement that serves the child’s best interests. We represent parents seeking sole custody, joint custody, or specific visitation schedules tailored to the family’s situation.
- Custody modifications. Life changes. A parent relocates. A child’s needs evolve. A parent’s circumstances deteriorate. Oklahoma courts will modify an existing custody order when a material change in circumstances warrants it. We handle modification petitions in Tulsa County and across Oklahoma.
- Custody disputes in divorce. When custody is contested within a divorce proceeding, the stakes are high on every front. Property division, spousal support, and parenting time are all being negotiated simultaneously, and each issue affects the others.
- Unmarried parent custody. For parents who were never married, custody cannot be addressed until paternity is established. Once paternity is determined, the father has the same right to seek custody as any other parent under Oklahoma law.
- Visitation and parenting time disputes. When a parent is being denied court-ordered visitation, or when the current visitation schedule no longer works, we pursue enforcement or modification through the court. Repeated failure to comply with visitation orders can be grounds for a custody modification.
- Relocation cases. When a custodial parent wants to move a significant distance from the other parent, Oklahoma law requires court approval. The relocating parent must show that the move is in the child’s best interests, and the non-custodial parent has the right to object.
Oklahoma Legal Requirements for Child Custody
Oklahoma’s child custody laws are primarily found in Title 43 of the Oklahoma Statutes. The central standard is the best interests of the child, codified in 43 O.S. § 109. The court must consider the child’s physical, mental, and moral welfare when making custody decisions.
Oklahoma does not presume that joint custody is better than sole custody, or vice versa. Under 43 O.S. § 112, there is no legal preference for or against any particular custody arrangement. The court also cannot prefer one parent over another based on gender. Each case is evaluated on its own facts.
When considering joint custody, the court evaluates whether both parents can cooperate effectively on major decisions about the child’s life. A written parenting plan is required, and it must address how the parents will handle decision-making, resolve disagreements, and divide physical time with the child. If the court determines that joint custody is not workable, it awards sole custody to one parent and establishes a visitation schedule for the other.
Oklahoma law gives the court discretion to consider the child’s preference, depending on the child’s age and maturity. Under 43 O.S. § 113, the judge may interview the child in chambers to determine the child’s wishes. But the child’s preference is just one factor. It does not control the outcome.
Domestic violence history weighs heavily in custody decisions. Under 43 O.S. § 109, the court must consider a parent’s history of domestic violence, stalking, or harassment as a primary factor. A DUI conviction can also influence how the court assesses a parent’s fitness, particularly regarding the child’s safety during visitation.
Important Aspects of a Tulsa Child Custody Case
How Judges Evaluate the Best Interests Standard
Oklahoma courts examine a wide range of factors when applying the best interests standard. These include the child’s relationship with each parent, each parent’s ability to provide stable housing and financial support, the child’s ties to their school and community, any history of substance abuse or domestic violence, and which parent is more likely to encourage a healthy relationship between the child and the other parent. There is no formula. Each judge weighs these factors based on the evidence presented.
The Role of a Parenting Plan
In both joint and sole custody arrangements, the court typically requires a parenting plan. This document spells out the day-to-day logistics of custody: which parent has the child on which days, how holidays and school breaks are divided, how transportation is handled, and how parents will communicate about the child’s needs. A detailed, workable parenting plan signals to the court that you are thinking practically about your child’s daily life. We help clients draft plans that address real-world logistics and anticipate common disputes.
When Custody Disputes Overlap with Other Cases
Custody issues rarely exist in a vacuum. A felony charge against one parent, a pending divorce, a paternity action, or a guardianship petition can all affect how a custody case proceeds. We coordinate across practice areas so that decisions made in one case do not undermine your position in another.
Documenting Your Case
The parent who walks into court with organized documentation has a significant advantage. School records, medical records, communication logs with the other parent, photographs, and third-party observations all matter. Social media posts can be used as evidence. Text messages are discoverable. We advise clients early in the process on what to preserve, what to document, and what to avoid posting online while the case is pending.
Co-Parenting After the Order Is Entered
A custody order is not the end of the process. It is the beginning of a co-parenting arrangement that will last until the child turns 18. How you communicate with the other parent, how you handle disagreements, and how you respond when schedules do not go as planned all affect whether the arrangement works. Courts notice patterns. A parent who cooperates and follows court orders is in a much stronger position if a modification dispute arises later.
Fathers’ Rights in Oklahoma Custody Cases
Oklahoma law does not favor mothers over fathers in custody decisions. The statute explicitly prohibits gender-based preferences. But many fathers still feel that the system works against them, particularly in initial custody determinations. We represent fathers who are seeking meaningful custody time and full participation in their child’s life. A father’s rights to custody are equal under the law once paternity is established.

A custody case determines the framework for your child’s upbringing. The outcome affects where your child lives, which parent makes key decisions, and how much time each parent gets to spend with the child. Those stakes demand careful preparation and a clear strategy.

Child Custody Statistics in Tulsa
Custody cases in Tulsa County begin inside a divorce or between parents who never married. Federal data show how common both situations have become, and how many children in Tulsa, OK live in a home where a court order defines each parent’s role.
Younger children are more likely to live with two parents than teenagers are, which means the schedule a court sets for a five-year-old often has to be revisited by the time that child is fifteen. A child custody lawyer Tulsa, OK families hire should be planning for that from the first filing.
- 75 percent of children under age 6 lived with two parents in 2023, compared with 68 percent of children ages 12 to 17, according to the Census Bureau.
- About 3.2 million children lived with cohabiting parents in 2023, up from 2.2 million in 2007.
- The CDC counted 672,502 divorces in 2023 across the 45 reporting states, a rate of 2.4 per 1,000 people.
What Should You Expect During a Tulsa Child Custody Case?
Most parents have never been inside the Tulsa County Courthouse before their custody case. The stages below run in the order they usually happen, and a Tulsa child custody attorney should be able to tell you which one you’re in.
- Filing and service. One parent files a petition, either on its own or as part of a divorce or paternity case. The other parent is served and has a set window to respond.
- Temporary orders. If the parents can’t agree on where the child lives while the case is pending, either side can ask the judge for a temporary order. This hearing is short, but the schedule it produces often shapes the final outcome.
- Disclosure and discovery. Both sides exchange information: work schedules, school records, medical records, and communications between the parents.
- Mediation. Tulsa County judges expect parents to attempt mediation before trial in most contested cases. Many custody disputes settle at this stage once both parents see a written schedule in front of them.
- Guardian ad litem or evaluation. In higher-conflict cases, the court may appoint a guardian ad litem to investigate and report, or order a custody evaluation by a mental health professional.
- Pretrial conference. The judge narrows the disputed issues and sets deadlines. Cases that haven’t settled by now usually settle here or proceed to trial.
- Trial. Each parent presents witnesses and evidence. Custody trials in Tulsa County are heard by a judge, not a jury, and often last a day or less.
- The final order and parenting plan. The judge signs a decree with a parenting plan attached. From that point on, the plan controls, and changes require either agreement or a modification case.
Tulsa Child Custody Lawyer FAQs
How much does a child custody lawyer in Tulsa cost?
It depends almost entirely on whether the other parent is reasonable. An agreed parenting plan can be finished for a fraction of what a contested trial with a custody evaluation costs. We give a realistic range at the first meeting and talk about the financial impact of litigation before anyone decides to fight over an issue that won’t change the outcome.
How long does a custody case take in Tulsa County?
Agreed cases can finish in a few months. Contested cases depend on the judge’s docket, whether a guardian ad litem is appointed, and how quickly both parents produce records. A custody evaluation alone can add months. A Tulsa child custody attorney should tell you at the outset which of those factors apply.
What is a guardian ad litem, and will one be appointed in my case?
A guardian ad litem is an attorney appointed by the judge to represent the child’s interests, not either parent’s. They interview the parents, the child, teachers, and sometimes therapists, then report to the court. Judges in Tulsa, OK tend to appoint one when the parents’ accounts sharply conflict or when a child’s safety is in question. The parents usually share the cost.
Do we have to go to mediation?
In most contested cases in Tulsa County, yes, before the judge will set a trial. A mediator can’t order anything, but a large share of custody cases settle there because both parents finally see a written schedule and realize a judge’s version could be worse. Our Tulsa custody lawyers prepare clients for mediation the same way we prepare for a hearing.
Can I get custody while the case is pending?
Yes. A temporary order sets where the child lives and how time is divided until the final decree. Judges are reluctant to move a child mid-case, so the parent who has the child at the start tends to keep that arrangement temporarily. That is one reason a custody lawyer in Tulsa files quickly when a client’s situation is unstable.
Can custody be settled without going to court?
A custody agreement still has to be approved by a judge, but the parents can write it themselves with counsel and submit it without a contested hearing. When custody is part of a divorce, a Tulsa divorce consultation covers both issues together. Agreed plans hold up better over time because both parents helped write them.
Does joint custody mean a 50/50 schedule?
Not necessarily. Joint custody in Oklahoma refers mainly to shared decision-making. The physical schedule can be equal, or it can be weighted toward one home based on school, work, and the child’s age. Parents assume the label decides the calendar, and the custody basics that separate the two are worth understanding before a hearing.
What if I’m worried about my child’s safety during the other parent’s time?
Tell your Tulsa child custody lawyer immediately, and document what you’ve seen. The court can order supervised visitation, require exchanges at a neutral location, or restrict overnight time when there is evidence of a risk. Vague concerns rarely change a schedule. Specific, dated incidents do. If the concern involves a pending criminal charge, a Tulsa criminal defense matter and the custody case need to be coordinated.
Will the court consider my work schedule?
Yes, and it should be in your evidence. A parent who works nights or rotating shifts can still have substantial time, but the plan has to be realistic. Judges in Tulsa are more persuaded by a parent who proposes a workable schedule around their job than by one who asks for time they can’t cover. We build the proposed calendar around real availability.
Can my child’s teacher or therapist be a witness?
Teachers can testify about attendance, behavior, and which parent is involved at school, and are often the most credible witnesses. Therapists are different. Many judges in Tulsa, OK prefer not to put a child’s therapist on the stand, and a guardian ad litem may gather that information instead. A custody attorney in Tulsa can subpoena records without disrupting the child’s treatment.
Important Resources for Tulsa Child Custody Cases

Custody cases are assigned to the Family Division of the Tulsa County District Court. The Court Clerk’s family relations counter on the second floor of the courthouse handles the filings, and temporary orders are heard on a separate docket from trials. Each family judge sets their own practices for mediation, guardian ad litem appointments, and scheduling. A child custody attorney in Tulsa, OK will ask which judge is assigned before recommending a strategy, because the answer changes it.

What Our Clients Say
⭐⭐⭐⭐⭐
“Right from the initial consultation, the attorneys and staff made it clear that they understood how emotional and overwhelming this process is. They listened, really listened to my story, my concerns, my goals. It helped me feel seen, not just a “case file.” That kind of empathy was worth a lot in reducing stress. Because it was my first divorce, I had zero idea what terms like “equitable distribution,” “spousal support,” and “custody evaluation” fully meant. The lawyers at Lai & Turner Law Firm took time to explain what each step meant, what documents I would need, what decisions would have long-term impact. If you’re going through a divorce and want someone who will make the process feel less scary and more straightforward, I can’t recommend Lai & Turner firm enough. They broke everything down in plain language, guided me step-by-step, and handled all the paperwork and court filings without me feeling overwhelmed. Whenever I had questions (and I had a lot), they responded quickly and patiently, no judgment, just support. Thank you Lai & Turner firm for being so compassionate during a very difficult, heartbreaking process.” – Jess
