Oklahoma Legal Requirements for Divorce
To file for divorce in Oklahoma, at least one spouse must have been a state resident for six months before filing under 43 O.S. § 102. The petition is filed in the county where the filing spouse has resided for at least 30 days.
Oklahoma recognizes both no-fault and fault-based grounds. Incompatibility is the most common ground under 43 O.S. § 101. You do not need to prove that your spouse did anything wrong. Fault-based grounds, which include adultery, abandonment, extreme cruelty, and habitual drunkenness, are less commonly used but can influence how the court handles property division and spousal support.
The mandatory waiting period is 10 days for divorces without minor children and 90 days for divorces involving minor children under 43 O.S. § 107.1. The court may waive the 90-day period for good cause shown.
When the petition is served, an Automatic Temporary Injunction takes effect under 43 O.S. § 110. This injunction prevents both spouses from disposing of marital assets, canceling insurance, or harassing each other while the case is pending. Understanding this injunction is critical because violating it can result in contempt of court.
Oklahoma is an equitable distribution state. The court divides marital property fairly, not necessarily equally. Separate property, like assets owned before the marriage or received as gifts or inheritances, is generally excluded from division.
