Oklahoma Legal Requirements for Divorce
Oklahoma’s divorce laws are found in Title 43 of the Oklahoma Statutes. To file for divorce, at least one spouse must have been an Oklahoma resident for six months immediately before filing under 43 O.S. § 102. The petition is filed in the county where the filing spouse has lived for at least 30 days, or in the county where the other spouse resides.
Oklahoma allows both no-fault and fault-based divorce. The most common ground is incompatibility under 43 O.S. § 101, which does not require either spouse to prove wrongdoing. Fault-based grounds include abandonment for one year, adultery, extreme cruelty, habitual drunkenness, gross neglect of duty, imprisonment for a felony, and fraudulent contract.
Once the petition is filed and served, an Automatic Temporary Injunction goes into effect under 43 O.S. § 110. This order prevents both spouses from hiding or disposing of assets, canceling insurance policies, harassing each other, or making major financial changes while the divorce is pending. Violating it can result in contempt of court.
The mandatory waiting period before a divorce can be finalized is 10 days when there are no minor children and 90 days when minor children are involved under 43 O.S. § 107.1. The 90-day period can be waived by the court for good cause shown.
Oklahoma is an equitable distribution state. Marital property is divided in a way the court considers fair, which may not be equal. Property acquired during the marriage is generally marital property. Separate property, such as assets owned before the marriage or received as gifts or inheritances, is typically not subject to division. But commingling separate property with marital funds can change its character, and these disputes often require detailed financial evidence.
