Types of Paternity Cases We Handle in Tulsa

A father who misses them may be permanently bound by the acknowledgment regardless of biological truth.
When paternity is contested, the court orders genetic testing under the act. If the test shows a probability of paternity of 99% or greater, the man is presumed to be the father. That presumption is difficult to overcome.

DNA Testing and What It Proves
Court-ordered DNA testing in Oklahoma is accurate to 99.9% or higher. When the results show a probability of paternity at 99% or above, the court presumes the tested man is the father. Both parties and the child submit samples, and the court typically assigns the cost to one or both parents. If the alleged father refuses to submit to testing, the court can enter a default judgment of paternity. DNA evidence is powerful, but it does not resolve custody or support on its own. Those are separate determinations the court makes after parentage is established.

Until paternity is established in Oklahoma, the mother of a child born outside of marriage has sole legal and physical custody. The father has no standing to seek custody or visitation, regardless of his involvement in the child’s life. The analysis considers each parent’s relationship with the child, each parent’s living situation, and any history of domestic violence or substance abuse.
