Oklahoma Legal Requirements for Child Custody
Oklahoma’s child custody laws are primarily found in Title 43 of the Oklahoma Statutes. The central standard is the best interests of the child, codified in 43 O.S. § 109. The court must consider the child’s physical, mental, and moral welfare when making custody decisions.
Oklahoma does not presume that joint custody is better than sole custody, or vice versa. Under 43 O.S. § 112, there is no legal preference for or against any particular custody arrangement. The court also cannot prefer one parent over another based on gender. Each case is evaluated on its own facts.
When considering joint custody, the court evaluates whether both parents can cooperate effectively on major decisions about the child’s life. A written parenting plan is required, and it must address how the parents will handle decision-making, resolve disagreements, and divide physical time with the child. If the court determines that joint custody is not workable, it awards sole custody to one parent and establishes a visitation schedule for the other.
Oklahoma law gives the court discretion to consider the child’s preference, depending on the child’s age and maturity. Under 43 O.S. § 113, the judge may interview the child in chambers to determine the child’s wishes. But the child’s preference is just one factor. It does not control the outcome.
Domestic violence history weighs heavily in custody decisions. Under 43 O.S. § 109, the court must consider a parent’s history of domestic violence, stalking, or harassment as a primary factor. A DUI conviction can also influence how the court assesses a parent’s fitness, particularly regarding the child’s safety during visitation.
