Obtain The Official Death Certificate
The first step is to get multiple certified copies of the death certificate. This document is required for nearly every legal and financial transaction, including closing bank accounts, claiming insurance benefits, and initiating probate.
You can usually request death certificates through the funeral home or directly from the provincial vital statistics office. It’s a good idea to get at least 10 certified copies, as many institutions require an original rather than a photocopy.
Notify Government Agencies And Financial Institutions
Once the death certificate is available, begin notifying key institutions.
Government agencies: This includes notifying the Canada Revenue Agency (CRA), Social Insurance Number registry, and Service Canada (for CPP, OAS, and other benefits).
Banks and credit unions: Contact all financial institutions where the deceased had accounts. You’ll need the death certificate and possibly a copy of the will to gain access or begin the process of account closure.
Pension providers and insurance companies: These agencies need to be informed to stop payments and process any survivor or beneficiary benefits.
Utilities and subscriptions: Notify utility providers, mobile carriers, and subscription services to close accounts or transfer responsibility.
Locate And Review The Will
If the deceased had a will, it should outline their wishes for asset distribution and appoint an executor. If you’re the executor, your role is to manage and distribute the estate in line with those wishes.
If you can’t find the will, check their home, safety deposit box, or attorney’s office. If no will exists, the estate will be handled according to intestate succession laws, which vary by province but typically prioritize spouses and children.
Initiate The Probate Process
Probate is the legal process that confirms the validity of the will and gives the executor authority to manage the estate. Not every estate requires probate, but in many cases, especially if the estate includes real estate or large financial accounts, it’s necessary.
You’ll need to file documents with the appropriate provincial court. Probate can take several months or longer, depending on the complexity of the estate and whether any disputes arise.
Manage Debts, Taxes, And Asset Distribution
As executor, you’ll be responsible for paying outstanding debts and bills, filing the final tax return for the deceased, and distributing assets to beneficiaries as outlined in the will. This often requires selling property, transferring titles, and closing accounts. Be prepared to maintain accurate records and keep beneficiaries informed along the way.
Transfer Ownership And Close Accounts
Once debts and taxes are settled, you can begin distributing the remaining assets. This includes transferring ownership of property and vehicles, closing bank and investment accounts, and transferring or selling personal belongings.
Be sure to check for digital assets as well, such as social media, email accounts, or online banking, and follow the necessary steps to manage or close them.
