After a crash or a fall in Lawton, an injured person may worry that their own mistakes will cost them the right to recover anything. Oklahoma law is more forgiving than that, but it does draw a line. We explain where the line sits and what evidence decides which side of it a person lands on.
Oklahoma Does Not Bar Every Partly At-Fault Claim
Title 23, section 13 of the Oklahoma Statutes says that contributory negligence does not prevent recovery in a personal injury, wrongful death, or property damage action. The exception is a case in which the injured person’s negligence is greater than the negligence of the party causing the harm. When several parties contributed, the comparison is to their combined negligence.
The statute is short. A person found fifty percent responsible isn’t barred, because that share isn’t greater than the other side’s, while a person found fifty-one percent responsible is.
Falls and Other Injuries Follow the Same Rule
The statute speaks to negligence resulting in injury to a person or property, so it reaches falls and other negligence-based injuries as well as crashes. Someone who slipped on a wet floor may be asked why they didn’t see the hazard. The same comparison applies, and the question is whether that person’s share of the fault is greater than everyone else’s combined.
The Comparison Turns on Evidence
Fault gets decided by what can be shown, not by what each side says. Useful evidence includes:
- Photos and video of the scene, the vehicles, and the injuries
- Statements from drivers, passengers, and bystanders
- Police and incident reports
- Medical records that tie treatment to the event
- Camera footage from nearby businesses
Footage gets overwritten, vehicles get repaired, and memories fade. Saving evidence early keeps every option open.
Some of this evidence sits with businesses and agencies that the injured person doesn’t control. Those hurt in Lawton can ask a Lawton personal injury lawyer to request that footage and reports be kept before they are lost.
Different Crashes Raise Different Fault Questions
Two passenger vehicles in a collision raise questions about speed, lane position, and attention. When the facts involve a car accident claim, the argument turns on who had the right of way and who was distracted.
Large commercial vehicles add more records to the picture. Logs, inspection records, and company policies can bear on a truck accident claim.
Riders face their own arguments about visibility and speed. Evidence that answers those arguments carries real weight in a motorcycle accident claim.
Fault Is Only One Part of the Value
Even a claim that clears the statute’s threshold has to be valued. Medical bills are part of the picture but not all of it, and calculating the true cost of an injury means looking at lost income, ongoing care, and the way daily life changed.
Timing matters as well. A person waiting to see whether pain fades can still ask early about when to hire a lawyer.
Some Disputes Reach the Courtroom
When an insurer and an injured person can’t agree on fault or value, the claim may move into a lawsuit. Injured people can turn to a Lawton civil litigation lawyer for the filing, the discovery process, and the courtroom side of that work.
Preparing early helps either way. Understanding how a lawyer can protect your rights helps an injured person make better choices about statements, records, and treatment.
