Our free truck accident settlement calculator gives you a rough estimate of what your injury claim might be worth. Answering the four short steps below takes about 60 seconds.
The tool asks about your injuries, your medical bills, the income you lost, and how much fault falls on you. You get back an estimated range with a breakdown of each damage category.
How the Truck Accident Settlement Calculator Works
The calculator moves through four steps, then shows an estimated range along with the reasoning behind it.
| Step | What you tell us | Why we ask |
|---|---|---|
| 1. Your injury | How serious your injuries were, from minor to catastrophic, and whether you are still treating | Severity is the biggest driver of pain and suffering value |
| 2. Medical costs | Your bills from the crash so far, plus how much future care you expect | Past and future treatment are both recoverable damages |
| 3. Lost income | Your usual monthly pay before the crash and how many months you could not work | Missed wages and reduced earning ability count separately |
| 4. Damages and fault | Vehicle and property damage, how clear the truck driver’s fault is, and your own share of fault | Oklahoma reduces your recovery by your percentage of fault |
After the fourth step, you enter your name, email, and the type of truck involved. The results page shows a range, a midpoint, and separate line items for medical expenses, lost income, property damage, and pain and suffering.
Our injury calculator uses the standard underlying method:
- Your economic damages get added together first.
- Then pain and suffering gets estimated by multiplying that figure by a number between 1.5 and 5, depending on how severe and lasting your injuries are.
- The total then drops by your share of fault.
Say your medical bills, lost wages, and vehicle damage come to $60,000. A multiplier of three puts pain and suffering at $180,000, for a total of $240,000. If you were 25% at fault, your estimate falls to $180,000.
A few things sit outside the formula. Policy limits can cap what you collect no matter how serious your damages are.
Punitive damages, loss of consortium, and the strength of your evidence all move the number in ways a slider cannot capture. Case results vary widely, even between two claims that look similar on paper.
Disclaimer: The calculator gives a rough educational estimate only. Using the tool does not create an attorney-client relationship and does not constitute legal advice. Truck accident results vary widely and depend on facts specific to each case.
Average Truck Accident Settlement Amounts
Truck accident settlement amounts vary so much that any single national average tells you very little about your own claim.
What Is the Average Settlement for a Truck Accident?
No official database of settlement figures exists, because most truck accident claim settlements are private and confidential.
The averages you find online come from individual firms publishing their own case files. A 2026 review of published truck accident settlement figures gathered results from six firms and found little agreement between them.
Only one firm gave an exact average, $103,654, and that same firm puts its median at $30,000. Others listed ranges of $100,000 to $500,000, with some cases climbing past $1 million.
That first pair of numbers shows why averages mislead. A handful of catastrophic cases pull the average upward, so half the claims in that dataset resolved below $30,000.
Sorted by severity, the same review found minor injury claims settling between $10,000 and $100,000. Severe injuries and fatal crashes start near $100,000 and can run past $1 million.
What Is the Average Settlement for a Semi Truck Accident?
No reliable average semi-truck accident settlement figure exists either, for the same reason. Semi cases can land higher than car accident claims, though, mostly because of insurance limits and injury severity.
Truck Accident Settlement Process
Most truck claims follow the same path, though the timing shifts with the severity of your injuries and how strongly fault is contested.
- Treatment and evidence preservation: Your attorney sends the trucking company a preservation letter right away. Engine control module data can be overwritten within days, and carriers only have to keep electronic logging records for six months.
- Investigation: Your legal team gathers the police report, driver logs, maintenance records, the driver qualification file, and any post-crash drug or alcohol testing.
- Demand letter: Once you finish treatment or reach maximum medical improvement, your attorney sends the insurer an itemized demand.
- Negotiation: First offers tend to come in low. Counteroffers move back and forth over weeks or months.
- Filing suit: If talks stall, a lawsuit follows. In Oklahoma district court, the defendant usually has 20 days after service to answer.
- Discovery and mediation: Depositions, expert reports, and a mediation session come next. Many cases resolve at this stage.
- Trial: Few claims reach a jury, though preparing for one often improves the offer on the table.
We suggest waiting until you understand the full extent of your injuries before accepting anything. Settling early can leave you covering future surgeries out of pocket.

Semi Truck Accident Settlement Claims
Semi claims run under federal rules that do not apply to ordinary car accident claims in Oklahoma, which changes both the evidence and the money at stake.
Federal hours-of-service rules cap driving at 11 hours within a 14-hour window, and only after 10 consecutive hours off duty. Electronic logging devices record that time, so a violation can support your claim directly.
More parties can share responsibility. The driver, the motor carrier, the company that loaded the cargo, a maintenance contractor, a parts manufacturer, and a freight broker may each carry a separate policy.
Evidence is also heavier and disappears faster. Driver qualification files, inspection reports, dispatch records, and engine data all matter.
Trucking insurers often send their own investigators to the scene within hours of a crash, which is one reason our Oklahoma City truck accident attorneys move quickly on evidence.
Factors Influencing a Truck Accident Settlement
Truck accident settlement factors decide whether your claim lands near the bottom of a range or closer to the top.
Adjusters and attorneys weigh the same handful of details when they put a number on a case.
Here is what carries the most weight:
- Injury severity: How badly you were hurt shapes your settlement more than anything else. Injuries that leave you with permanent limits raise the multiplier applied to pain and suffering.
- Medical costs, past and future: Every bill you can document builds the base of your claim. Expected future treatment counts too, so we suggest waiting until your doctor knows what care you still need.
- Lost income and earning capacity: You can recover the pay you missed while you were out of work. If your injuries keep you from returning to the same job, the drop in future earnings gets added on top.
- Your share of fault: Oklahoma cuts your recovery by whatever percentage of the crash was your fault. Once your share passes 50%, you cannot recover anything at all.
- Available insurance coverage: Federal rules require interstate carriers to hold at least $750,000 in liability coverage. A larger policy raises the ceiling on what you can collect, though you still have to prove your losses.
- The number of parties at fault: More than one company may share the blame for a truck crash. Each separate policy adds to the money available to settle your claim.
- Strength of the evidence: Driver logs, maintenance records, and federal safety violations make liability harder to argue against. Solid proof usually brings a better offer.
- When you settle: Accepting an offer before you finish treatment can leave real costs off the table. Once you sign the release, you cannot go back for more.
Frequently asked questions (FAQs)
Below are a few questions we hear often from truck accident clients across Oklahoma.
How Long Does a Truck Accident Settlement Take in Oklahoma?
Truck accident case settlement time depends mostly on injury severity and whether the trucking company disputes fault.
- Clear fault with moderate injuries: often 6 to 12 months
- Serious injuries with ongoing treatment: 12 to 24 months
- Disputed fault, several defendants, or catastrophic injuries: 2 to 4 years
Cases that reach trial run longer. Waiting is often worth it, since offers tend to improve once the trucking company sees you are prepared to file suit.
How Much Does It Cost to Hire a Truck Accident Lawyer?
Nothing upfront. Truck cases run on a contingency fee, so payment comes out of the recovery. Contingency rates across the industry commonly fall between 33% and 40%.
Case expenses such as expert witnesses, filing fees, and crash reconstruction are usually advanced by the firm and deducted separately.
At Lai & Turner, your case evaluation is free, and injury claims run on contingency. You can read more about how our legal fees work.
How Long Do I Have to File a Truck Accident Claim in Oklahoma?
You have 2 years from the date of the crash to file a truck accident claim in Oklahoma. For a wrongful death, those 2 years start on the date the person died. Some claims have shorter deadlines, so it is best to check with an attorney as soon as you can.
Who Can Be Held Liable in a Truck Accident Claim?
More than one party often shares responsibility in a truck accident claim settlement.
- The truck driver, for negligent driving
- The motor carrier, through respondeat superior or for negligent hiring, retention, or maintenance
- The company that loaded or secured the cargo
- A maintenance contractor that missed a defect
- The manufacturer of a defective part
- A freight broker, depending on the arrangement
Each party may carry its own policy, which can raise the total money available to you.
How Do You Negotiate a Truck Accident Settlement?
You negotiate a truck accident settlement by sending the insurer a demand letter that itemizes every loss. Finish your treatment first so future care is included in the total. Expect a low first offer and be ready to counter it.
